There are no great surprises in what motivates the business community when choosing an appropriate forum and procedure for managing and resolving disputes. The overriding objectives generally advanced are fairness, efficiency (including speed and cost) and certainty in the enforcement of contractual rights and protections. Thus increased acceptance of non-litigious forms of dispute resolution have popularized Alternative Dispute Resolution (ADR) methods like arbitration and mediation. They are increasingly used in international and domestic commercial practice due to the significant benefits, such as reducing the instances where a dispute leads to the termination of a commercial relationship, facilitating the administration of international transactions by commercial parties and producing savings in the administration of justice.
But in spite of the increasing global acceptance of arbitration and mediation, the professional growth in India has not been encouraging. There is need to implant professional institutional negotiations, mediations and arbitrations with professional, independent and neutral negotiators, mediators, arbitrators and capable secretarial service. There is a need for a global interaction among ADR practitioners and business world for effective promotion and use of ADR at international level.
IIADRA is conscious of its responsibility. IIADRA is dedicated to spawn new initiatives and techniques in improving ADR, generate movement which enables parties to co-operate to achieve a consensual settlement which best meets the specific needs of all affected parties, by working with their lawyers and other professionals without resorting to litigation.
We are committed to:
♦ Augment the base of the Association by increasing the members, which would include serious ADR professionals and ADR users from India and abroad.
♦ Create constant opportunities for communication and interaction among ADR professionals globally and within India and to form a group of “Thought Leaders” who could assist the association in formulating and suggesting schemes for improvement of domestic as well as international ADR operations.
♦ Encourage companies and organisations to formally pledge their commitment to resolve disputes in a private and forward-looking manner, which would be practical, affordable and reliable and which could transform potential crises into strengthened relationships.
Towards this IIADRA conducts International and National Conferences, Seminars, ADR Talks and partners with corporate houses and industry for promoting consensual dispute resolution options.
